ActionEdge provides market research services to its customers. We take great care in protecting your privacy and the information you provide whilst conducting research with us. This privacy policy applies to all our customers, respondents as well as visitors. This Privacy Policy describes how ActionEdge collects, uses, and discloses information, and what choices you have with respect to the information.

 

Services

It is ActionEdge’s policy to respect your privacy regarding any information we may collect while we contact you for research and on our websites, collectively called the Services. This Privacy Policy applies when you use our Services. ActionEdge contacts respondents using phone calls and sometimes emails for the purpose of primary market research. All these are collectively called “Services”.

Research Invitations & Requests

We contact you for research only if you meet our requirements. We contact potential respondents via calls or emails and who meet some or all of the following criteria:

    You recently purchased from or were contacted by one of our clients during a recent event/seminar/conference

    You have given permission to a company to supply your details to a third party for research purposes.

    You have taken part in previous research administered by ActionEdge and given us your permission to contact you in the future for research purposes.
Privacy and rights’ notification

For online surveys, a link to this privacy policy will be available as part of the surveys. All respondents contacted via phone are directed to our privacy policy on our website by notifying them using the following statement.

“I am calling you from ActionEdge based in India.  We are a market research company and offer loyalty and reward programs to survey participants.  We received your telephone number from [insert name of public record here].

You may request to access, correct, or delete the personal data we hold about you. Please visit our Privacy Notice on https://www.action-edge.com/privacy-policy/ to find out more about our data protection practices and how you can contact us with privacy inquiries.”

Information we collect

As a Respondent, you provide data to us for processing during the research study. We will disclose to you the nature of the research or how the data will be used. Where the research is for a client (also called a customer) of ours, we will disclose our client’s name. In response, you provide us with data for surveys and market research. These include personal data about yourself in addition to responses to actual surveys.

When we contact you, we generally do so for one of the following purposes:

    To confirm the details of research you have agreed to take part in

    To conduct research with you

    To validate answers/views you gave in a recent research we conducted (if you have consented to us doing so)

    To update and to ensure that our records of your personal information are correct (applicable to those consenting to being part of our panel)

    To notify you if you have won a prize draw that we administered or to provide you with an incentive for taking part.
Personal Data Collected

Certain personal data is collected and stored for our research purposes. The information we collect can contain your personal opinions as well as personal data such as name, address, postcode, gender (optional), occupation, age (optional), email address, telephone number, etc. We record and retain our voice calls with you for regulatory purposes as evidence of consent. In addition to this, we also collect personal data in form of web opt-ins. Where relevant to the research being undertaken, we may collect business contact information, such as company name, job title, and department. In addition, for online surveys, we will record your IP address and other basic metrics.

Your responses will be treated as confidential unless you consent to be identified.

Other Data

We also collect data when you use our website. When you enquire about our products and services, we collect and store this data to communicate with you and respond to your inquiry.

Data from Others

ActionEdge may receive your data from sources other than from you which are sourced from publicly available sample sources. We collect data such as respondent’s Full Name, Business Phone, Company, Job Title, and other demographic information.

Data Provided by Business and Consumer Directories.

As part of customer data processing, we collect or receive data from well-known business and consumer directories that are publicly sourced.

 

How we use your data

How we use your personal data will depend on which Services you use and how you use those Services.

Lawful bases for processing

We have a lawful basis to process your personal data. We also use your consent as a basis for lawfully processing your personal data.

We process your personal data only when we have a lawful basis. Presently, we use the Performance of Contract (i.e. to deliver the services to our customers) and consent as the lawful basis for processing. For certain processing, we may also use legitimate interests as provided under the Data Protection Regulations.

Where you have consented to a particular processing, you have a right to withdraw the consent at any time. When we use legitimate interest for processing, you may object to such processing.

How we use Respondent data?

We use your data to contact you for surveys and support you thereafter. We only process respondent data for the purposes of the market research surveys. If we initially collected your information for the phone survey, we may use this data for future online surveys and vice versa.ActionEdge collects such information only that is necessary for the research:

    To send emails and other communications. We may send you service-related communications to inform you about changes in our services and our service offerings.

    Customer Support – If you send us a request (for example via a support email or via one of our feedback mechanisms), we respond to your request or help your issues.

The personal data we collect is:

    Combined with the responses/views/opinions of others who participated in the same research and reported back anonymously to the client that commissioned the study.

    Used to administer and operate prize draws/incentives

    Occasionally used to re-contact you to validate your responses

    Personal information is never sold/resold to any third party

All of your survey responses are treated as confidential. We will never intentionally disclose your personal information or individual survey responses to the client that commissioned the study or any third parties unless you consent to share your personal data and/or individual responses.

Direct Marketing

We may send you marketing / promotional materials. You may choose to restrict the collection or use of your personal information. We will update you with improvements in our services, and new features direct marketing is carried out only if you consent to receive such communications from us.

Users under 16 years of age

The Sites and Services do not knowingly collect personal information from users under the age of 16. We never knowingly invite children under the age of 16 to participate in research studies without taking measures to ensure appropriate consent from a responsible adult.

Data Retention Policy

We will retain your personal information for as long as is needed to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

Respondent Data retained only as necessary

ActionEdge retains personal details of Respondents for a period of two years from the date of collection or the date of the last contact, whichever is later. If you choose to have your information deleted or opt-out from future surveys, then we will delete all information except the limited information necessary to avoid contacting you again.ActionEdge may retain Other Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy.

Your Rights

You can request to access, update or correct your personal information. You also have the right to object to direct marketing.You may have additional rights pursuant to your local law applicable to the processing. For example, if the processing of your personal information is subject to the EU General Data Protection Regulation (“GDPR”), and your personal information is processed based on legitimate interests, you have the right to object to the processing on grounds relating to your specific situation. Under GDPR you may also have the right to request to have your personal information deleted or restricted and ask for portability of your personal information.

The California Consumer Privacy Act (CCPA) gives consumers more control over the personal information that businesses collect about them. As a business CCPA does not apply to ActionEdge since ActionEdge does not meet any of the following criteria. Similarly to CCPA, Virginia Consumer Data Protection Act (VCDPA), California Privacy Rights Act (CPRA), Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), Utah Consumer Privacy Act (UCPA) does not apply to ActionEdge since these laws does not affect ActionEdge as we do not meet few/all of the following requirements.

CCPA/CPRA

  • Have a gross annual revenue of over $25 million.
  • Buy, receive, or sell the personal information of 50,000 or more California residents, households, or devices; or
  • Derive 50% or more of their annual revenue from selling California residents’ personal information.

UCPA

  • Conduct business in Utah or produce products or services targeted to Utah residents
  • Either (A) process personal data of 100,000 or more Utah residents; or (B) derive more than 50 percent of their gross revenue from the sale of personal data and control or process the personal data of 25,000 or more Utah consumers.

VCDPA

  • They either conduct business in Virginia or produce products or services targeted to Virginia residents; and
  • During a calendar year (i) control or process personal data of at least 100,000 consumers; or (ii) control or process personal data of at least 25,000 consumers and derive over 50 percent of their gross revenue from the sale of personal data.

CPA

  • Applies to a controller that conducts business in Colorado or produces or delivers commercial products or services that are intentionally targeted to residents of Colorado; and
  • Controls or processes the personal data of 100,000 consumers or more during a calendar year: or
  • Derives revenue or receives a discount on the price of goods or services from the sale of personal data and processes or controls the personal data of 25,000 consumers or more.

CTDPA

  • Conduct business in Connecticut, or produce products or services targeted to CT residents; and
  • During the preceding calendar year, either (a) controlled/processed the personal data of at least 100,000 consumers (excluding for payment transactions), or (b) controlled/processed the personal data of at least 25,000 consumers and derived more than 25% of gross revenue from the sale of personal data.

ActionEdge is not a data broker as ActionEdge does not sell personal data to any third party.

Still, ActionEdge abides by four privacy rights, as defined below.

  • The right to opt-out
  • The right to non-discrimination

Your Rights to Control Your Data

Whenever you use our services, we aim to provide you easy means to access, modify, delete, object to or restrict the use of your personal information strive to give you ways to access, update/modify your data quickly or to delete it unless we have to keep that information for legal purposes. You can contact us at research@action-edge.com  regarding exercising the following rights:

    Change or Correct Data: You can also ask us to change, update or fix your data in certain cases, particularly if it’s inaccurate.

    Delete Data: You can ask us to erase or delete all or some of your personal data (e.g. if it is no longer necessary to provide Services to you).

    Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your personal data (e.g. if we have no legal right to keep using it) or to limit our use of it (e.g. if your personal data is inaccurate or unlawfully held).

    Right to Access and/or Take Your Data: You can ask us for a copy of your personal data and can ask for a copy of personal data you provided in machine-readable form.

If you have been contacted by ActionEdge and have not given such permission or just wish your name to be removed from the database, let us know. We will remove you from the contact list for that particular research project and inform the relevant organization that supplied your details.

Recipients of your data

ActionEdge does not sell your personal information to third parties. Processing of prizes/incentives may result in your contact details being passed onto a third party i.e., Amazon etc. This would purely be for the prize/incentive to be sent out to you electronically and would not result in any marketing or follow-up.

To Comply with Laws – If we receive a request for information, we may disclose if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation, or legal process.

We will not sell your personal information to third parties. From time to time we may employ other companies and individuals to perform functions on our behalf. They will have access to the personal information needed to perform their functions, but will not use it for other purposes.

Processing of prizes/incentives from the result may result in your contact details being passed onto a third party, i.e. Amazon. This would purely be for the prize/incentive to be sent out to you electronically and would not result in any marketing or follow-up.

The following categories of the recipient will most likely receive your data in order for us to provide services to you:

    Third party survey developers / programmers so that we can create and roll out online surveys to you
  • Image
    Third party market research companies / online and offline panel companies who will receive only certain personal data such as age and gender.

To Comply with Laws – If we receive a request for information, we may disclose if we reasonably believe disclosure is in accordance with or required by any applicable law, regulation, or legal process.

Cross-Border Data Transfers

Your data will be stored and processed in multiple countries including outside of the European Union (EU) Region. Since we are an international company, your data will be processed outside of the EU region. Some countries where we process data may not have as protective laws as your own country and there are risks associated with such transfer. You agree to the cross-border transfer of your data to countries outside of the EU region.

Security Measures

We implement security controls to prevent breaches and unauthorized access to your data. We maintain reasonable and appropriate security measures to protect customer data from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Examples of security measures include physical access controls, restricted access to data, monitoring for threats and vulnerabilities, etc.

Updates to this Privacy statement

ActionEdge may change this privacy policy from time to time, at our sole discretion. Any changes will become effective when we post a revised version of this Privacy Statement on this Site. We encourage you to review this Privacy Statement periodically to remain informed about how we are protecting your data. For online surveys, a link to this privacy policy will be available as part of the surveys.
